Nintendo Subpoenas Discord to Identify User Behind Pokemon "TeraLeak"

Nintendo is actively pursuing legal action to identify the individual behind the significant Pokemon leak known as the "FreakLeak" or "TeraLeak." The company has filed a request for a subpoena from a California court, aiming to compel Discord to disclose the personal details of the user "GameFreakOUT." According to court documents cited by Polygon, Nintendo seeks the name, address, phone number, and email address of this user. Last October, GameFreakOUT allegedly shared copyrighted Pokemon content, including artwork, characters, source code, and other materials, on a Discord server named "FreakLeak." This content was subsequently spread widely across the internet.

While not officially confirmed, the leaked materials are believed to have originated from a data breach disclosed by Game Freak in October, which occurred in August. The breach compromised the personal information of 2,606 current, former, and contract employees. Interestingly, the leaked files surfaced online on October 12, and Game Freak's statement, backdated to October 10, was released the following day, focusing solely on the employee data breach without mentioning any other confidential company materials.

The "FreakLeak" revealed a wealth of information about unannounced projects, including cut content, background details, and early builds of various Pokemon games. Among the leaks was information about "Pokemon Champions," a battle-focused game announced in February, and "Pokemon Legends: Z-A," with some details already confirmed. The leak also included source code for DS Pokemon titles, meeting summaries, and cut lore from "Pokemon Legends: Arceus" and other games, as well as information on the next generation of Pokemon.

Although Nintendo has not yet initiated a lawsuit against any hacker or leaker, the pursuit of this subpoena suggests they are intent on identifying the person responsible. Given Nintendo's history of taking strong legal action against piracy and patent infringement, a successful subpoena could be the precursor to further legal proceedings.
