Palworld Developer Pocketpair Says It’s Being Forced to Patch the Game Due to Nintendo and The Pokémon Company’s Lawsuit

In a recent development, Palworld's developer, Pocketpair, has disclosed that recent patches to the game were implemented due to an ongoing patent lawsuit filed by Nintendo and The Pokémon Company. Palworld, which launched early in 2024 on Steam for $30 and simultaneously on Game Pass for Xbox and PC, achieved unprecedented sales and concurrent player numbers. The overwhelming success led Pocketpair's CEO, Takuro Mizobe, to admit that the company struggled to manage the immense profits generated by the game. Capitalizing on this success, Pocketpair swiftly entered into a deal with Sony to establish Palworld Entertainment, aimed at expanding the game's intellectual property, and later released the game on PS5.

Following its launch, Palworld faced accusations of copying Pokémon designs, leading to comparisons between its creatures, known as Pals, and Pokémon. However, instead of pursuing a copyright infringement lawsuit, Nintendo and The Pokémon Company opted for a patent lawsuit, seeking 5 million yen (approximately $32,846) each, plus additional damages and an injunction to halt Palworld's distribution.

Pocketpair confirmed in November that it was being sued over three Japan-based patents related to capturing Pokémon in a virtual field. This lawsuit was linked to Palworld's mechanic of capturing monsters using a Pal Sphere, reminiscent of the mechanic in the 2022 Nintendo Switch game, Pokémon Legends: Arceus.

Six months later, Pocketpair admitted that recent changes to the game, specifically Patch v0.3.11 released in November 2024, were a direct result of the legal action. This patch modified the game by removing the ability to summon Pals by throwing Pal Spheres, replacing it with a static summon beside the player, alongside other gameplay mechanic adjustments. Pocketpair stated that failing to make these changes would have led to a more significant decline in the gameplay experience.

Moreover, with the release of Patch v0.5.5, further adjustments were made, shifting the gliding mechanic from using Pals to using a glider that players must carry in their inventory. Despite these changes, Pals can still offer passive gliding buffs. Pocketpair described these modifications as "compromises" forced upon them to avoid an injunction that could disrupt Palworld's development and sales.

Despite these concessions, Pocketpair remains committed to challenging the lawsuit, focusing on proving the invalidity of the patents in question. In their official statement, Pocketpair expressed regret over the changes but emphasized their necessity to prevent further development disruptions. They also apologized to their fans for the ongoing legal issues and reaffirmed their dedication to delivering new content for Palworld.

During the Game Developers Conference (GDC) in March, IGN interviewed John "Bucky" Buckley, Pocketpair's communications director and publishing manager. Buckley, who had previously discussed Palworld's challenges at the conference, including accusations of using generative AI and stealing Pokémon models, noted that the patent lawsuit from Nintendo was unexpected and unforeseen by the studio.
